3. Profit, Loss and Commercial Risk

Except in cases of intent or gross negligence, ExcellaGLOBAL cannot be held liable for any direct, indirect, incidental or consequential loss arising from the use of its services or of the information on this website.

4. Third Party Platforms and Systems

The following actions by those platforms fall outside ExcellaGLOBAL's responsibility:

• Account suspension, held balances or blocked access,
• Technical faults, payment system problems and outages.

Any loss arising in such cases is a matter between the user and the platform concerned.

5. Account, Access and Security Responsibility

Ultimate ownership, security and legal responsibility for any ad account, store panel, integration, domain, hosting service, social media account or payment system to which ExcellaGLOBAL is given access for management, setup or analysis remains with the client.

• Unless at fault itself, ExcellaGLOBAL is not liable for loss arising from incorrect or incomplete access permissions supplied by the client, security vulnerabilities, two factor authentication failures, leaked passwords or interference by unauthorised third parties.

6. Legal Compliance and Data Protection (GDPR / CCPA)

Protecting the personal data of end customers collected and processed through the client's e-commerce sites, marketplace stores or ad accounts, and complying with the applicable regulations such as GDPR and CCPA, is the client's obligation as data controller.

To the extent it processes data on the client's behalf within the scope of the service, ExcellaGLOBAL meets its own obligations as a data processor. Beyond that, ExcellaGLOBAL cannot be held liable for administrative or legal penalties arising from the client's incomplete privacy notices, faulty cookie policies or their own data collection practices.

7. Customs, Tax and International Regulation

All guidance shared by ExcellaGLOBAL on global trade, logistics and e-commerce is advisory in nature.

The client is responsible for their products meeting the health, safety and customs regulations of the destination country, for those products not infringing any trademark or patent, for tax matters such as VAT, sales tax and income tax, for import and export permits, and for the risk of goods being held or destroyed at customs.

8. Force Majeure and Unauthorised Interference

ExcellaGLOBAL cannot be held liable for loss caused by incorrect changes made to store panels, ad campaigns or technical infrastructure by the client, their staff or third parties they authorised, without ExcellaGLOBAL's knowledge or approval.

No legal or criminal liability arises for ExcellaGLOBAL in the following force majeure situations:

• Global or regional cyber attacks and ransomware,
• Server, hosting and data centre outages,
• Failures of general internet infrastructure and telecommunications,
• Natural disasters, war, embargo, civil unrest and epidemics,
• Sudden suspension or blocking decisions taken by authorities or platforms.

9. Intellectual Property

All strategies, business models, analysis methods, software, designs, text, creative content and documents appearing on the ExcellaGLOBAL website, shared during the delivery of services, or produced by ExcellaGLOBAL, are protected by intellectual property law.

Without prior express written permission from ExcellaGLOBAL, this material may not be copied, reproduced, imitated, shared with third parties or competitors, or used for commercial gain even with attribution. Where a breach is identified, ExcellaGLOBAL reserves the right to begin any legal or criminal proceedings available to it.

10. No Partnership or Agency
